These Terms of Service (“Terms”) form a legally binding agreement between you and MAC Soft (“we”, “us”, or “our”). By accessing or using the atime.com.my website, the A Time HRMS dashboard, and any associated mobile applications (collectively, the “Platform”), you agree to be bound by these Terms.

1. Provision of Service

A Time provides cloud-based human resource management, facial verification attendance, and GPS tracking solutions. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform strictly in accordance with your employer's subscription plan and these Terms.

2. Acceptable Use & Anti-Fraud

As a core function of the Platform is attendance verification, you agree that you will not:

  • Attempt to spoof, bypass, or manipulate the facial recognition or GPS location systems.
  • Use emulators, mock location apps, or printed photographs to falsify attendance records.
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform.
  • Share your login credentials with any other person.

Any detected fraudulent activity will be logged and reported directly to the registered employer (Data Controller) and may result in immediate suspension of your access.

3. Privacy & Data Processing

Your use of the Platform is also governed by our Privacy Policy. By using the service, you acknowledge that we process biometric and geolocation data strictly on behalf of your employer as a Data Processor.

4. Service Availability & Maintenance

We strive to ensure 99.9% uptime for the Platform. However, we may occasionally suspend access for scheduled maintenance or emergency updates. We will not be held liable for any loss of business, data, or inconvenience resulting from such planned or unplanned downtime.

5. Intellectual Property Rights

All software, design, text, graphics, and underlying source code within the Platform are the exclusive property of MAC Soft. You are granted no rights to our intellectual property other than the limited right to use the Platform as an end-user.

6. Limitation of Liability

To the maximum extent permitted by applicable law, MAC Soft and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or HR administrative errors arising from the use or inability to use the Platform.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
